HLG Secures $2.75 Million Injury Settlement
Hornsby Successfully Protects Client's Settlement
When you are injured on the job by a defective product, your personal injuries can be devastating. But, imagine how surprised you would be to learn that your employer can sue you if you settle your personal injury case.
That is what happened to our 18-year old client, Heather Dalton. While working for a Pilgrim's Pride poultry plant, our client's clothing was caught in a defective piece of machinery and her right arm was amputated. We successfully helped our client obtain a $2.75 million product liability settlement.
A few months later, Pilgrim's Pride sued Heather. It wanted our client to pay back all of the medical benefits and money she had received through worker's compensation.
We immediately helped Heather fight back. We argued that while our client had received an excellent settlement, under Georgia law "she was not able to be fully compensated" for her injuries. That argument persuaded Pilgrim's Pride to drop its case.
The result is that our client was able to keep her full settlement without fear of losing even one dollar.
